Seller Policy

Requirements and duties for sellers on MilesMarket.

1. Purpose

  • This Seller Policy sets out the requirements and duties for all sellers on MilesMarket. It supplements the Terms and Conditions and the Acceptable Use Policy.

2. Eligibility

  • Sellers may be natural or legal persons.
  • Sellers must be at least 18 years old and have full legal capacity, or act as an authorized representative of a company.
  • MilesMarket may make activation of a seller account conditional on successful identity verification.
  • There is no right to be admitted as a seller.

3. Seller account

  • Every seller is obliged to maintain a complete and truthful profile.
  • Changes to personal or business data must be updated without delay.
  • Selling via multiple accounts to circumvent restrictions or suspensions is prohibited.
  • Access credentials must be kept confidential and may not be passed on to third parties.

4. Permitted listings

Sellers may only list items they are legally entitled to dispose of. The offered reward values must be described correctly to the best of their knowledge. The following listings are in particular prohibited:

  • from hacked or compromised accounts,
  • with forged evidence,
  • with deliberately false information,
  • that violate applicable law,
  • whose origin cannot be substantiated.

5. Responsibility for loyalty programs

  • Sellers are solely responsible for being entitled to transfer the offered reward values or to provide the agreed service.
  • Sellers are obliged to observe the participation terms of the respective loyalty program on their own responsibility.
  • MilesMarket does not check whether a listing is compatible with the terms of a specific loyalty program.
  • Sellers bear all consequences that may arise from measures taken by a loyalty program operator.

6. Listing quality

Listings must in particular contain:

  • correct name of the loyalty program,
  • amount of miles or points offered,
  • selling price,
  • required preconditions,
  • delivery method,
  • delivery time, if applicable.
  • Misleading or incomplete information is not permitted.

7. Delivery obligation

  • Sellers undertake to render the agreed service within the timeframe stated in the listing.
  • Delays must be communicated to the buyer without delay.
  • If delivery becomes permanently impossible, the buyer must be informed without delay.

8. Duties to provide evidence

MilesMarket may in particular request the following evidence:

  • proof of the existence of the loyalty account,
  • proof of authority to dispose,
  • communication records,
  • screenshots,
  • booking confirmations,
  • further documents, as required to handle a dispute.
  • Requests are made in compliance with applicable data protection laws.

9. Fees

  • For successfully completed transactions, the brokerage commission stated in the fee schedule applies.
  • Payment processing takes place via Stripe Connect.
  • MilesMarket does not hold customer funds.

10. Taxes

  • Sellers are themselves responsible for fulfilling their tax obligations.
  • MilesMarket does not provide tax advice.
  • Sellers must themselves assess whether and to what extent their revenues are taxable.

11. Disputes

  • Sellers are obliged to cooperate in disputes.
  • Requested information must be provided within the deadline set by MilesMarket.
  • Incomplete or deliberately false information may be taken into account in the decision.

12. Quality standards

Sellers undertake in particular to:

  • communicate politely,
  • deliver on time,
  • provide correct information,
  • provide complete evidence on request,
  • comply with this policy.

13. Prohibited conduct

The following are prohibited in particular:

  • price manipulation,
  • sham transactions,
  • self-purchases to improve ratings,
  • review manipulation,
  • circumvention of platform fees,
  • deception of other users,
  • circumvention of suspensions.

14. Controls

To ensure a safe marketplace, MilesMarket may, subject to statutory requirements:

  • review listings,
  • request additional information,
  • verify sellers,
  • temporarily hide listings,
  • check transactions for anomalies,
  • restrict or suspend user accounts.

15. Sanctions

In the event of violations of this Seller Policy, MilesMarket may in particular:

  • issue warnings,
  • remove listings,
  • restrict selling functions,
  • temporarily suspend seller accounts,
  • permanently close seller accounts,
  • notify authorities where legally required or permitted.
  • Measures are taken with regard to the severity of the violation and while preserving the rights of the affected users.

16. Termination of the seller function

MilesMarket may terminate the seller function or the seller account in particular if:

  • this policy has been repeatedly violated,
  • significant security risks exist,
  • statutory requirements so demand,
  • false identity information has been provided,
  • there is a serious suspicion of fraud.

17. Amendments

  • MilesMarket may adapt this Seller Policy to legal or technical developments and to changes in the business model.
  • The current version is published on the platform.
