Acceptable Use Policy

1. Purpose

• This Acceptable Use Policy ("AUP") governs the permitted use of the MilesMarket platform. It supplements the Terms and Conditions and serves to protect all users and the integrity of the platform.

2. Principle

• Every user undertakes to use the platform exclusively in a lawful, fair and good-faith manner.
• MilesMarket may remove content or restrict accounts if this policy is violated.

3. Prohibited listings

In particular, the following content or listings are prohibited:

• stolen airline miles
• stolen hotel points
• hacked customer accounts
• loyalty rewards obtained without authorization
• forged evidence
• manipulated screenshots
• listings under a false identity
• misleading listings
• fraudulent listings
• unlawful vouchers
• stolen voucher codes
• listings whose sale is prohibited under applicable law

4. Prohibited conduct

In particular, it is prohibited to:

• deceive other users,
• use false identities,
• create multiple accounts to circumvent suspensions,
• use automated bots,
• mass-copy content,
• circumvent security mechanisms,
• distribute malware,
• send spam,
• carry out DDoS attacks,
• engage in automated price manipulation,
• threaten or insult users,
• publish discriminatory content,
• support money laundering,
• circumvent statutory sanctions or embargoes.

5. Loyalty programs

• MilesMarket brokers listings for loyalty programs.
• Each user is responsible for complying with the terms of the respective programs, offering transferable reward values and ensuring the lawfulness of their transactions.
• MilesMarket generally does not check listings for compatibility with the terms of individual loyalty programs.

6. Automated use

Without prior written consent, the following are prohibited in particular:

• scraping
• data mining
• automated price queries
• bots
• automated registrations
• use of the API outside of released interfaces

7. Security

Users are in particular not permitted to:

• use third-party passwords,
• take over third-party accounts,
• exploit security vulnerabilities,
• upload malicious code,
• distribute viruses,
• deploy malware.
• Security vulnerabilities must be reported to MilesMarket without delay.

8. Reviews

Reviews must be based on actual transactions. The following are prohibited in particular:

• paid reviews,
• fake reviews,
• revenge reviews,
• extortion through reviews,
• review manipulation.

9. Communication

Communication must be respectful. The following are not permitted:

• insults,
• hate speech,
• threats,
• sexual harassment,
• discrimination,
• spam,
• advertising outside the platform.

10. Circumventing the platform

• It is prohibited to use the platform to specifically move users to conclude the same transaction outside of MilesMarket in order to circumvent platform fees.

11. Sanctions

In the event of violations, MilesMarket may, taking into account the severity of the individual case, in particular:

• issue warnings,
• remove content,
• deactivate listings,
• restrict features,
• temporarily withhold payouts, where legally permissible and necessary for clarification,
• temporarily suspend user accounts,
• permanently suspend user accounts,
• notify authorities, where required or permitted by law.

12. Reporting procedure

• Any user may report unlawful content or violations of this policy.
• MilesMarket reviews reports within a reasonable time and takes the necessary measures.

13. Amendments

• MilesMarket may adapt this policy to legal changes, technical developments or adjustments to the business model.
• The current version is published on the platform.
